At fault driver's car insurance won't pay for my damages!?

Hey guys and gals, My wife was in a car accident on 10/8 driving our truck with liability only insurance (IE: not full coverage because the truck is only worth ~$3000 and it's paid for). She was turning right and had slowed down to turn (with her turn signal on) when a speeding truck slammed into the van behind her, ramming the van in to our truck. The police filed a report, in which the driver of the speeding truck (an 18 year old kid, that had just left his house less than 1/4 mile away) was determined to be at fault. It is worth note that this happened in front of two different auto body shops, and within sight of the house the at fault driver had just left. Their insurance company, state farm, finally contacted us on 11/8 after not returning our phone calls for nearly two weeks saying they had determined he was in fact at fault and would send an adjuster the following Monday. He came, inspected the truck, determined it was repairable, then said we would hear from their office later that day. When they called they told us the damage was more than 75% of the vehicles worth so it was considered total and they would send the required paperwork to my email address to begin payment. Within 3 hours, the claim agent we had talked to the previous Friday said an owner of one of the auto shops had came forward (all of a sudden, no mention of a witness before) and that he had a notarized statement saying the van struck our vehicle before the truck struck the van. The insurance company now will not pay us for the damages. We tried to call the witness and get a copy of his report because State Farm would not give us the copy. Then we called the other auto body shop and both the owner and one of his employees both seen the accident and say that the truck was at fault, and the owner overheard the driver say specifically that it was his fault. When we bring this to the agents attention, she claims this is not evidence because they know the at fault driver. We found out that the first witness also knows the driver, but can't prove it. Ours is a small town, you don't have neighbors that you don't know or speak to. It seems we are at an impasse, and I have been without a truck for nearly 6 weeks. What should I do in this instance? Get an attorney? Our insurance agency is adamant about not intervening since we did not have full coverage insurance. It may be worth noting that my wife has had back and neck pain since the accident and went to the hospital the day of the accident, the family doctor twice since, and has an appointment with a chiropractor next week (all of which our insurance has paid for.)

I'm a childhood bone cancer survivor. I had osteosarcoma back in 1992 and had my leg amputated but the cancer never returned and the only issue after is I can't donate blood. Just wondering if anyone has an idea on how much insurance will cost. The insurance for the V6 model I know will be somewhere around $400-$500 a month which is obviously too much for me. I plan on putting a 3k down payment for the Mustang and finance for possibly 4-5years. I also plan on selling my current car for a little over 2.2k. My 17 year old son was driving his 2003 Ford Explorer, when he was hit by another vehicle. My son was approaching a stop light and traveling between 3-5 mph....The vehicle that struck him was a company work vehicle. The work truck was pulling out of a parking lot when he hit my son. His estimated speed was also 3-5 mph. There were no injuries at all, and there was no medical treatment sought. This all happened on April 10th 2011. It was found that driver of the work truck was at fault for inattention. Honestly, this guy was super nice and walked my son through the process of calling police etc til I could get there....Now dealing with the Companies insurance carrier has been a headache!!!! here is the basic timeline....Explorer still drivable....Had to wait 10 days for police report....contacted Company that owned work truck, and they forwarded me to their insurance co....Was advised to seek several estimates, and fax them over....Faxed over estimates to adjuster. All estimates exceeded 5k....Stated she would have to contact an adjuster from local area to work this. Local adjuster came out. Estimated damages to be 3300.00. Insurance Company sent me check for 3300.00 and advised me when vehicle repaired, auto shop would need to work with adjuster on any additional repairs and costs. Explorer was in shop 30 days before finally being totaled. Local adjuster was horrible to work with, did not communicate with body shop, etc. I finally contacted the insurance company, and told them I refused to deal wither contracted adjuster etc. Now that the vehicle has been totaled, they don't want to pay what I think is fair. The insurance company wants to settle for $6928 plus $367 for taxes. Clean retail for the Explorer is $8100. This is for my area. I have been car shopping for 2 days straight. can't find anything comparable with the money they gave me etc. I have taken off work to deal with this etc, been going on for 2 months plus, and Iam worn out with it all...All I want is for my kid to be back in a safe reliable vehicle. The insurance company did provide a rental car. I was in a car accident when a girl blew a red light and smashed into my side. $10,000 in auto damages that was fixed rights away. (btw she admitted fault to police so im 0% at fault legally) I went to emergency room for precautionary reasons. That cost $1450. Then little by little the pain started to kick in. I had neck pain, shoulder pain, back pain and terrible pain in my knee. I had MRI on back, knee and neck because those were the worst. That total was about $1800. I was told by the doctor that the mri on my back said I have two herniated disks and I should do therapy. I listened to him and went four times per week for four months. The Mri on my neck came back good. But my knee showed a tear in mcl. I had surgery on that and had to see the surgeon in his office twice plus hospital bills which equals a bill of $14,500. I then needed 2 months of therapy on my knee. Also all the pain meds ive been taking through out the whole process is around $600. I had a ekg for my nerves to test if they were good and that cost $800. So after doing my research I find websites that say the settlement amount s should be all bills multiplied by 3 depending on the persons insurance carrier and coverage. Well this person has $200,000/$200,000. So far all my bills have been paid through my insurance. When I do the math for what all the bills are is comes to roughly $28350. I didn't include the four days per week for therapy and seeing the doctors. That has to be a big chunk also. My lawyer called me and said he was made an offer of $42,000. He gets a 1/3 of that. I think they low balled me soooo bad on this. If i use the X3 multiplier method then it should have been somewhere around $85,000 offer. Remember I didn't even include all the visits to the therapy. Is this a good offer or should I decline and wait for second offer? My lawyer thinks we should wait it out because he has such a big insurance policy that we can get much more especially since that was our first offer.

Both Vehicles had to be towed away. I have good insurance on our cars, but since this isn't my fault the other woman's insurance will have to pay my medical bills, and to fix my truck, or give me blue book value on it right? I had accident earlier this year(few months ago) wasn't my fault and other side admitted it but they still haven't paid for damages so the case is still open. Ok, so I live here in phoenix arizona. I haven't had insurance on my car for a while up until Friday November 2, 2012 when I got paid from work. (Don't harass me for this it was a stupid decision. I live five minutes away from my work and that is all I do is work and home). Now, was heading into work and I thought I was parked. I was on private property, I was at Arrowhead Mall here in az. There are no camera's. etc. I thought I put my car in park when I had it in reverse and I started fiddling around for my purse in the passenger seat. I lifted my foot off the break and the car started rolling backwards and before I knew it I hit the other car that was parked. There was no one in the car and we swapped insurance information but because I had just gotten insurance that day it didn't process til November 3rd. So my insurance wouldn't cover the claim. Now I'm screwed and the guy is telling me that he is out of state and would like to get this fixed before he leaves. He was told that the claim has to be settled between us now. I want to make this right. It was my fault. But there was no police report. So, the guy is looking around for estimates on fixing his bumper. If I can't pay in the time frame he needs me too pay, what can I do? I don't think i can even get a loan because I don't know about my credit history and I'm not having family or friends help in this. I just don't know what actions I can even though I want to help him and make my mistake right.

I haven't had health insurance since I turned 18 and no longer qualified for my family's health insurance plan. I wasn't really concerned at the time, but now that its been a few years (I am almost 21 now), I am in need of dental care. My problem is that I don't know what my health insurance options currently are. I am a college student, although my community college does not offer any health plans for students. I do have a part time job at a daycare that offers health insurance, however its price is far too high for my income. The insurance company is Aetna, and would cost me $16.92 for the lowest medical option, plus $4.61 for dental. So that would cost me $21.53 weekly, which doesn't sound too bad, except I only earn about $120 every two weeks....reducing my paychecks to about only $76 every two weeks....which just isn't enough for me to live on considering that I pay for my own food and everything else needed. So.... does anyone know of health insurance companies that have options for community college students like me? I know state insurance may be an option, but I have a feeling I don't qualify for that since I'm not legally an independent, yet I can't afford to move out and become independent. I got into a car accident 3 years ago. Due to my car lost control during raining weather. There was no one involved but myself and the police cited me for reckless driving. I took it upon myself to go to traffic school both times to wipeout some of the points off my driving record, but some how my insurance still upped my premiums yet again. My question is how long will it take for my premiums to go down or have the accident removed from my record? I know of other people who have worse records but their insurance isnt at much as mine. Also I've had my license for 13 years and have in all that time just have been in 1 accident and 2 speeding tickets. Any help would be appreciated.

Always been a fan of Old Minis. Always been in the family. Uncle has had various Mini projects. I've read so many different things about classic car insurance. I'm 17 Years old, recently passed. I've heard that you get get classic car insurance at this age for close to and under 1000. I may not be driving until i turn 18. Won't be driving much. Odd weekend's and to Sixth form a few late days when i can't get a lift off my parent. My Sixth form has it's own car park and the car will be parked on the drive. I had an accident a month or two ago. It was in a rental car. I found out today that the insurance company had disallowed some of the charges that the rental company tried to pass to them. Now the rental company is trying to pass those charges to me. They ammount to about $500, plus my deductible, of course. The charges are $100 for an administrative fee $200.89 loss of use fee $139.38 diminished value fee. Who should pay these charges? Should I fork this money over to the car rental company? Should the insurance company pay them? What strategy should I use in my conversations with them? My feeling is that I have insurance, it should pay everything which is an actual cost above and beyond the deductible. ie if I have to pay it, the insurance company should have to pay it. On the other hand, if they are somehow bogus charges, then the rental company can eat it, and that's fine. Thought?

The car in question has an MOT however it needs extensive repairs and is not drivable. Yesterday i was on my way to work and I was stopped waiting to turn left, there was a car in front of me stopped as well, who was turning in the same direction.
